$750,000 Recovered for Client Rear-Ended by Commercial Truck Driver Talking on Cell Phone
Attorney Joe Terry of Terry & Thweatt, P.C. filed suit in Harris County, Texas on behalf of a client who was violently rear-ended by an employee driving a company truck on a Houston freeway while talking on his cell phone during a rain storm. The evidence obtained by Terry & Thweatt through exhaustive discovery and multiple depositions demonstrated that the Spanish-speaking employee was not aware of a company policy which prohibited employees from talking on cell phones while driving, mainly because this policy was contained in a manual written entirely in English and the employer had failed to explain the policy or have the manual translated to Spanish. Furthermore, it was discovered that the employee was told by the company to sign off on the policy manual when he was hired, despite the fact he had no idea what he was signing. Our client suffered significant injuries to her neck and back as a result of the collision for which surgeries were recommended. Following two mediations, Terry & Thweatt secured a settlement of $750,000 shortly before trial. Attorney’s fees and expenses totaled $317,062.20.
