When we send our children off to school in the morning, we do not stop to think whether or not they will come home safe and unharmed. We expect the school to educate and take care of them. But some parents find the system has failed them.

The parents of Dustin Chan were devastated after their son collapsed and later died at Dulles Middle School on January 13, 2014. Nothing can replace their beloved son, but the attorneys at Terry & Thweatt, P.C. assisted the parents in a lawsuit against Kickstart to bring justice for their son’s death.

Dustin Chan was participating in a Kickstart karate class at Dulles Middle School when he collapsed. However, the instructor did not send a student for a school nurse for nine minutes. While awaiting EMS, a defibrillator was not use nor was CPR performed on Dustin. Thirteen days after his collapse, he died.

Terry & Thweatt P.C. helped parents Bobby and Sheila Chan, devastated by the death of their son, file a lawsuit against Kickstart, which was won late March.

Attorney Lee Thweatt said when speaking at the Fort Bend Independent School District Board of Trustees meeting, “his death was as preventable as it was tragic.”

Bobby and Sheila Chan deserve justice in the loss of their son.  The attorneys at Terry & Thweatt, P.C., witnessing their pain and also saddened by the loss of Dustin Chan, have worked diligently to achieve justice.
